We handle all personal data in accordance with the Kenya Data Protection Act 2019, the Data Protection (General) Regulations 2021 and guidance from the Office of the Data Protection Commissioner (ODPC).

This Privacy Policy explains how Love After Forty Ltd (Herein referred to as we, us or our) collects, uses, discloses and protects personal data when you use our dating service, website, social media platforms and related services (collectively the Service).

Who We Are

Mapenzi Connect is a service of Love After Forty Ltd, a limited company registered in Kenya.

Our goal is to provide a safe and meaningful space both online and offline for adults to connect through Mapenzi Connect app, website, webinars and curated events.

The Data Controller is Love After Forty with known registered office as Nairobi, Kenya with a designated Data Protection Officer that can be reached by emailing support@mapenzi-connect.co.ke.

Personal Data We Collect

We collect only the information necessary to deliver safe, high-quality matchmaking and community experiences.

The categories of data collected include identification and contact data, verification and trust data, health and wellness where no medical tests results stored, financial and transaction data like confirmation of service pay via M-pesa and event participation for instance webinar or event attendance, consented photos or videos taken during events among others.

Sensitive Data

We may collect personal data about you which falls under the sensitive category of data.

This includes details about your race, ethnic social origins, religious belief, biometric data, marital status, family details including details of your children, parents, ex-spouses, genetic data, health status and sexual orientation.

We rely on the legal basis provided in clause 6 below for such collection.

How We Use Your Data

Our main goal is to ensure your experience on Mapenzi Connect is an enjoyable one. Therefore, your data is used to:

• Create and manage your Mapenzi Connect account.

• Verify identity and authenticity to maintain community trust.

• Suggest suitable matches and connection recommendations.

• Process membership and event payments.

• Send service updates, event notifications and service-related notices

• Improve our app, website and events experience.

• Fulfill our legal and regulatory obligations.

We never sell or lease your personal data to third parties.

Lawful Basis for Data Processing

Under the Data Protection Act, 2019 processing of personal data is lawful when based on one or more of the following:

• Consent – You have given clear consent for us to process your data.

• Contract – Processing is necessary for the performance of our services.

• Legal obligation – We retain data for tax, accounting and compliance reasons.

• Legitimate interest – To maintain platform safety, prevent fraud and improve services.

Data Sharing and Disclosure

Our goal of helping you make meaningful connections is the only reason we will share personal data whenever necessary under confidentiality agreements:

• With accredited partner clinics to confirm health badge completion.

• With verified service providers like payment processors, hosting platforms, or event partners.

• With law enforcement or regulators if required by law.

• With members you interact with.

We follow a strict vetting process prior to enganging all third parties who must comply with our confidentiality and data-protection standards.

Data shared with our service providers and partners is to help us operate, distribute, market and improve our services.

Data shared for marketing purposes adheres to the Data Minimization principle with limited information on client in hashed and non-human redable form.

When you use our platform, some profile information you choose to share such as name, age, interest among others may be visible to other registered users, in line with your prefered privacy settings and such forms data shared with members you interact with.

Transfer of your information may occur if we are involved whether in whole or in part, in a merger, sale, acquisition, re-structuring, dissolution, bankruptcy or other change of ownership or control.

All data sharing by Mapenzi Connect is done in accordance with the principles of lawfulness, fairness, transparency, purpose limitation and data minization under the Kenya Data Protection Act, 2019.

Direct Marketing

From time to time, we may also use your personal data to contact you for market research or to provide you with information about other services we think would be of interest to you.

You may be required to opt-in or give any other form of explicit consent before receiving marketing messages from us.

We respect your right to control personal data depending on which of our services you use.

Therefore, we will always give you the opportunity to opt-out of receiving such direct marketing or market research communications. You may exercise this right to opt-out at any time.

Not all promotional emails and SMS can be controlled via the opt-out option.

You may contact us at any time to opt out of receiving marketing messages through our email support@mapenzi-connect.co.ke.

Cross-Border Data Transfer

If your data is stored or processed outside Kenya (for example, on secure cloud platforms) we ensure the destination country or provider upholds adequate data protection safeguards consistent with the Kenya Data Protection Act, 2019.

Retention of Personal Data

Mapenzi Connect will keep your personal data only for as long as we need it for legitimate business purposes and as permitted by applicable law.

If you decide to stop using our services, you can close your account and your profile will stop being visible to other members.

Note that we will close your account if you have been inactive for a period of one (1) year.

Once your account is closed, we will delete your personal information, as laid out below:

• To protect the safety and security of our members, there is a safety retention window of three months following account closure or six months following an account ban. During this period, we keep your information in the event that it might be necessary to investigate unlawful or harmful conducts.

• Once the safety retention window elapses, we delete your data and only keep limited information for specified purposes as stated below:

• We maintain limited data to comply with legal data retention obligations; in particular, we keep records of consent members give us for five years to evidence our compliance with applicable law.

• We maintain limited information on the basis of our legitimate interest; we keep customer care records and supporting data for five years to support our customer care decisions, enforce our rights and enable us to defend ourselves in the event of a claim related to existence of past accounts and subscriptions.

• We also maintain information on the basis of our legitimate interest where there is an outstanding or potential issue, claim or dispute requiring us to keep information on legal matters concerning court.

Security Measures

We pride ourselves on taking all appropriate security measures to help protect your information against loss, misuse and unauthorized access or disclosure.

We use reasonable security measures to safeguard the confidentiality of your personal information.

We maintain strong technical and organizational safeguards including:

• Encrypted connections

• Access limited to authorized personnel only

• Secure password and authentication protocols

• Regular risk assessments and staff training

• Confidentiality undertakings by staff and partners

Data Breach Notification

In the unlikely event of a personal data breach, we will notify the ODPC within 72 hours as required by law.

Also, we will inform affected individuals if there is a high risk to their rights or freedoms.

Your Data Protection Rights

The applicable Data Protection Laws do grant you the right to:

• Be informed that we are processing personal data about you and the reason for processing.

• Request access to your personal data that we have on record. This right entitles you to know whether Mapenzi Connect holds personal data of you and if so, obtain information on and a copy of the personal data.

• Request Mapenzi Connect to rectify any of your personal data that is incorrect or incomplete.

• Object to and withdraw your consent to processing of your personal data. This right entitles you to request that Mapenzi Connect no longer processes your personal data. The withdrawal of your consent shall not affect the lawfulness of processing based on prior consent before its withdrawal. We may also continue to process your personal data if we have a legitimate or legal reason to do so.

• Request the erasure of your personal data. This entitles you to request the erasure of your personal data including where such personal data would no longer be necessary to achieve the purposes.

• Request the restriction of the processing of your personal data. This right entitles you to request the Mapenzi Connect only processes your personal data in limited circumstances where the processing is stopped but the data is retained.

• Request portability of your personal data. This right entitles you to receive a copy of personal data that you have provided in a structured machine-readable format. The right also requests Mapenzi Connect to transmit such personal data to another data controller in an electronic format.

Children’s Data

Mapenzi Connect is a relationship platform strictly intended for mature singles adults aged 18 years and above.

We do not knowingly collect, use or store any personal data from minors.

We have put in place mechanisms to verify the age and obtain consent before processing data.

All Mapenzi Connect users are required to verify their age through identification or other suitable means before registration or participation in any service or event.

Individuals under 18 years are not allowed to create profiles, attend events or access our platforms.

If we become aware an individual under age of 18 has registered with us and provided us with personal information, we will prompt steps to remove the data and restrict access.

Cookies and Analytics

We may store some information (using cookies) on your computer when you visit our website and app. This enables us to recognize you during subsequent visits.

The type of information gathered is non-personal such as IP address of your computer, date and time you accessed, the pages you browsed and whether the services sought were successfully delivered to you.
